How do HVNL penalties, infringement notices and demerit points work?
Short answer
The HVNL sets maximum court penalties, allows infringement notices for prescribed offences, and leaves demerit points to participating states and territories; the three consequences are related but not interchangeable.
Plain English
An authorised officer who reasonably believes a prescribed HVNL offence has been committed may issue an infringement notice as an alternative to taking the matter straight to court. The notice identifies the alleged offence and the amount payable, while the recipient generally has jurisdiction-specific options to pay, seek a review or elect to have the allegation determined by a court.
NHVR guidance states that the infringement amount for an infringeable HVNL offence is 10 per cent of the maximum court-imposable penalty. More serious offences may be court-only. The maximum penalty written against an offence is a ceiling available to a court, not the automatic amount imposed in every case.
Demerit points are separate again. They attach to a driver’s licence under the road-traffic law of the relevant state or territory. Only some HVNL offences attract points, and paying or being convicted of an offence may trigger them according to the applicable jurisdictional rules.
What this means operationally
When a notice arrives, identify the alleged offence, legal section, person or company named, risk category, payment deadline, review process, court-election process and any demerit-point consequence. Record the date of service and assign one person to manage the response.
Do not confuse paying an infringement with correcting the underlying safety problem. A defect direction, improvement notice, prohibition notice or permit condition may still require separate action even if a monetary penalty is paid.

Heavy-vehicle drivers, operators, employers, executives and other Chain of Responsibility parties who receive or manage an HVNL infringement, charge or related licence consequence.
Example
An operator receives an infringement notice alleging a prescribed record-keeping offence. The operator must decide within the stated process whether to pay, seek review or elect court. If a driver-specific offence also carries demerit points under the relevant state law, those points are a separate licence consequence.
Exceptions and traps
Not every HVNL offence is infringeable, and an authorised officer may choose a court process where the law and enforcement policy permit. Review, payment and court-election procedures differ between jurisdictions and must be taken from the actual notice.
Western Australia and the Northern Territory do not apply the HVNL domestically. Their own heavy-vehicle, road-traffic and infringement systems apply, although an interstate operator may still be subject to the HVNL when operating in a participating jurisdiction.
What changed
The current NHVR penalty schedule is split because indexed amounts applied from 1 July 2026, then offence amendments under the Heavy Vehicle National Law Amendment Act 2025 commenced on 1 August 2026. Use the schedule covering 1 August 2026 to 30 June 2027 for current offences.
