What are HVNL codes of practice?

Short answer

An HVNL code of practice is guidance issued by the NHVR that a court may use as evidence of what was known about a hazard, risk, assessment method or control at the relevant time.

A current code, such as the 2026 Master Code, helps Chain of Responsibility parties and executives understand practical ways to manage heavy-vehicle safety risks. It is influential evidence, but it is not the only lawful way to control a risk.

What this means operationally

Compare your safety-management system with the current code, record any gaps and either adopt the code’s controls or document an alternative that provides equivalent or higher protection. If relying on an alternative in court, the HVNL requires written notice to the other party at least 28 days before the hearing.

Who it applies to

Chain of Responsibility parties, their executives, advisers, investigators, prosecutors and courts considering heavy-vehicle safety duties.

Example

A scheduler uses the Master Code’s fatigue and scheduling guidance to test whether delivery windows, escalation rules and monitoring controls reduce public risk.

Exceptions and traps

A code does not create a separate offence and is not the only way to comply. A party may rely on other evidence or an equivalent or higher safety method, subject to the HVNL’s evidentiary and notice requirements.

What changed

On 1 August 2026, the former registered-industry-code framework was replaced by the current framework under which the NHVR issues, amends and revokes codes of practice after the statutory publication process.

Previous rule

The previous HVNL framework allowed industry-developed codes to be registered as Registered Industry Codes of Practice, commonly called RICPs.
